What is Mental Capacity?

Mental Capacity defines your ability to make a specific decision at the time the decision needs to be made.

You need to be able to understand information relating to your life and be able to make decisions about this.If you are able to understand the information and are therefore unable to make a decision about your health or finances then you are said to lack mental capacity to make the decision.

If you are deemed to have mental capacity then you should at least have a general understanding of the following:

  • The decision that is needed to be made.
  • Why you are making the decision.
  • Any information relevant to the decision.
  • What is likely to happen when you make the decision.
